On 31 July 2019, Khanna City two police Station had booked the accused Eva Dass, aged about 25 years and a resident of Tezpur in Assam, under sections of NDPS act after heroin was recovered from her near a mall on GT road in Khanna.
As per prosecution, on 31 July 2019, Sub Inspector Avtar Singh along with other officials was present near a Mall, GT Road, Khanna, for special barricading. They were checking the suspected vehicles and at 11.30 am, police officials saw a white swift car coming from Gobindgarh side and thereafter, same was stopped. Police officer stated that swift car was bearing number HR-55W-8632 and a clean shave person, aged about 40 year was sitting on the driver seat and a woman aged about 24 year was sitting on the rear seat along with a ladies bag (purse). The driver was identified as Amit Mongia of Vikaspuri in Delhi whereas the woman sitting on the rear seat of the car identified herself as Eva Dass. Police later recovered heroin from her purse and she was arrested. Police then presented chargesheet against the accused in the court.
During trial of the case, the accused woman pleaded false implication.
The counsel for accused argued that no independent witness was joined in the present case.
The court observed that even as counsel for the accused stated that no independent witness was joined in the present case, but it is clear that prosecution had examined 10 witnesses in the present case and all the witnesses had given their statements in official capacity.
“So, learned counsel for the accused failed to prove that how the witnesses examined by the prosecution are not trustworthy,” the court remarked.
